2 COM .7 [Uniquement en anglais] Opening of the session The Deputy Assistant Director General for Operations (Culture and Communication) responded on behalf of the Director General of UNESCO. Mr. Bolla expressed UNESCO's sincere appreciation for the invitation by the Government of the United States of America to hold the second session in Washington. In greeting members of the Committee and wishing them success in their work, he indicated the important role of international organizations such as UNDP, UNEP, IBRD, IDB, WFP, OAS and ALECSO in providing crucial support to conservation measures. In this context, he also expressed UNESCO's gratitude to the host country for its intellectual and financial support to a number of conservation projects throughout the world. He then reported on the present situation regarding the Convention concerning the Protection of the World Cultural and Natural Heritage (hereinafter referred to as "the Convention"). Forty (40) Member States of UNESCO had ratified or accepted the Convention as of 23 August 1978 and other Member States were about to do so. Thus the Committee would be enlarged to twenty-one members, as provided for under the Convention, when the next election to the Committee took place on 24 November 1978, at the second General Assembly of States Parties to the Convention to be held during the next General Conference of UNESCO. He continued with an analysis of the geographical distribution of States Parties to the Convention and pointed out that nine States Parties belonged to the Arab Region, eight to the African Region, eight to the Western European and North American Region, seven to the Central and Latin American Region, five to the Asian and three to the Eastern European Regions. Mr. Bolla noted that, while this distribution was a fairly balanced one, still greater efforts would have to be made to increase further the number of States Parties, particularly in the Asian and Eastern European regions. He then highlighted the fact that a number of outstanding cultural and natural properties had already been nominated by States Parties for inclusion in the World Heritage List, which set a high standard for the future designation of properties for the List. In reviewing the present financial situation of the World Heritage Fund, he stressed the crucial importance of voluntary contributions to the Fund. Mr. Bolla then expressed the opinion that the time had probably not yet come to launch a world-wide mass media campaign aimed at the general public for publicising the Convention, as this might be more effective when a greater number of concrete achievements could be shown. In this connection, Mr. Bolla stressed the importance of starting immediately with operations under the Convention and he suggested that necessary action be taken without delay to enhance knowledge of the Convention among decision-makers in all Member States of UNESCO. However, preparatory work should already commence to plan future information activities intended for the general public. Finally, Mr. Bolla recalled that the Committee had so far adopted all its decisions with the full consensus of all its members. He concluded with the hope that the decisions adopted at this session would also be unanimous.

The Committee expressed the wish that the Secretariat, in the preparation of a new draft agreement, take note of the following observations and recommendations made by delegates during the discussion:

17. With regard to Article 2 paragraph 5: The delegate of Poland recommended rewording to avoid obligation to meet expenses (for instance, for medical treatment) in convertible currency for countries with a non-convertible currency. Several delegates considered that governments should be encouraged to employ the fellow to the extent possible upon his return, in the field for which he has been trained under the fellowship rather than to force governments to do so as a condition sine qua non.

18. With regard to Article 3, as the delegate of Canada pointed out, not all States Parties had adhered to the Convention on the Privileges and Immunities of Specialized Agencies of the UN system. He therefore recommended that the wording of Article 3 be reconsidered by taking into account specific regulations by which some of the States Parties might be bound.

19. With regard to paragraph 3 of Article 3, the delegate of the United States of America requested that the stipulation not to impose commercial bank charges should be reconsidered as it might be difficult to apply this clause in some countries.

20. With regard to paragraph 5 of Article 3, the delegate of Canada expressed doubt that the "save harmless clause" would be an appropriate provision, as its legal value from the point of view of his government was questionable.

21. Article 4 should also contain a provision for the use in the agreement of the official language(s) of the country receiving assistance.

22. As regards paragraph 3 of Article 4, the delegate of Canada recommended the following clause: "In the event of termination, the undertakings assumed in this arrangement will continue to apply to the extent necessary to permit the orderly withdrawal of personnel and funds and the settlement of accounts, provided that in no case will the arrangement continue to apply for a period longer than (- x - months or years)."

In order to overcome this the Committee adopted the following changes in the French text: the criteria against which cultural properties would be evaluated, which are set out in point a) (ii) should read "... sur le développement de l'architecture, de la sculpture monumentale, de la conception des jardins et paysages, des arts connexes, des conceptions de l'urbanisme ou de l'habitat ..." instead of "... sur le développement ultérieur de l'architecture, de la sculpture monumentale, de la conception des jardins et des paysages, des arts connexes ou de l'habitat ...".

Point a) (v) should read "... formes d'habitats humains traditionnels ou de conceptions urbanistiques ..." instead of "... formes d'habitats humains traditionnels ...". Upon the Rapporteur's proposal, the Committee decided to amend also the corresponding English text in order to add the same clarifications.

2 COM VI.29 [Uniquement en anglais] Consideration of Public Information Activities In reporting on the work of the sub-Committee, its Chairman outlined the objectives of the proposed public information programme, in the following terms. Firstly, the programme should focus upon the aims of the Convention, the work of the Committee, the criteria for the inclusion of sites in the World Heritage List and the types of assistance available to States under the Convention, providing examples of assistance already granted; the World Heritage List should be de-emphasized until such time as there were sufficient sites on the List to make it appear truly representative of the world's heritage. Secondly, the programme should be at two levels, international and national. At the international level, UNESCO, ICOMOS, ICCROM and IUCN channels and facilities should be used. At the national level, States adhering to the Convention should be encouraged to promote the Convention through their governmental machinery. The Canadian Government Booklet on the Convention, distributed to delegates, was noted as a good example of a national governmental initiative. The assistance of non-governmental organizations in each State should also be enlisted by States to promote the objectives of the Convention; these would include not only the national committees of international organizations such as ICOMOS and IUCN, but also other conservation-oriented non-governmental organizations. The Chairman of the sub-Committee then proceeded to present suggestions for a three-year public information programme.

The Committee agreed with the proposal mentioned in paragraph 33 as put forward by the Secretariat and consequently decided that this preparatory assistance could, in exceptional cases, take the form of financial assistance.

2 COM VIII.45 [Uniquement en anglais] Review of Nominations to the World Heritage List The delegate of Poland then drew the attention of the Committee to paragraphs 20 and 21 of the report of the Rapporteur on the first meeting of the Bureau. As noted in the report, Poland was the only State affected by the decision that on this first occasion, States Parties would be limited to nominating only two properties each for inclusion in the World Heritage List, since it had nominated three sites which clearly qualified for inclusion and for which complete documentation had been submitted: Auschwitz, Cracow and the Salt Mines of Wieliczka. It would, therefore, appear justified that the nomination of Auschwitz be referred to the second session of the Bureau with a favourable recommendation.

Some delegates felt it desirable that States Parties sharing cultural or natural properties of a comparable nature should consult each other for the purpose of harmonizing approaches in the selection of properties for the World Heritage List. It was also stated that the criteria for selection of properties for the World Heritage List should be discussed in more detail in the future in order to facilitate selection and evaluation of candidate World Heritage properties.

The delegate of Yugoslavia emphasized that the choice of an emblem was of great importance. The emblem would symbolize for future generations the principles embodied in the Convention. The Committee felt that the proposed emblem fully satisfied the criteria of universality and simplicity, and conveyed the essential objectives of the Convention. Consequently it decided to adopt the emblem in its two graphic versions both to be used, in any colour, depending on the use to be made of them, the technical possibilities and considerations of an artistic nature.

He went on to describe the project undertaken by the Egyptian Government in co-operation with UNESCO and the World Food Programme for the preservation of the Philae temples, to which the WFP had made a substantial contribution in the form of food assistance as part- payment of wages for about 1,700 workers engaged in the restoration of the monuments. The project, in addition to its evident cultural value, would also provide an opportunity to develop the tourist industry in the area and help diversity the economic development of the Aswan region. In concluding, the observer of the World Food Programme referred to the success of the operation which, in that Organization, was known as "bread and stones".

  • Makaminan Makagiansar, Sous-Directeur général pour la Culture et la Communication de l'Unesco a ouvert la réunion on accueillant, au nom Directeur général et en son propre nom, les délégués des États parties et les autres participants. il a souligné le rôle essentiel de la Convention dans les travaux de l'Organisation. Les objectifs de cette Convention sont d'une part de préserver le témoignage du génie créateur de l'homme et les richesses de la nature et, d'autre part, de contribuer à l'amélioration de la qualité de la vie et de promouvoir l'identité culturelle. Passant en revue les progrès accomplis depuis la première Assemblée générale en ce qui concerne la mise on œuvre de la Convention, M. Makagiansar s'est félicité de l'accroissement du nombre des États parties et a informé l'Assemblée générale des travaux entrepris par le Comité depuis sa formation. Après avoir formulé le vœu que de nombreux États se joignent à ceux qui ont déjà ratifié ou accepté la Convention, il a rappelé les deux tâches principales qui attendaient l'Assemblée, à savoir l'élection de membres du Comité et la détermination du montant de la contribution au fonds prévue à l'article 16, paragraphe 1 de la Convention.

    10. Le Président a expliqué à l'Assemblée générale comment celle-ci devrait procéder à l'élection des membres du Comité. Etant donné l'accroissement du nombre des États ayant ratifié ou accepté la Convention, le nombre des membres du Comité serait porté de 15 à 21. En conséquence, il faudrait élire, d'une part, cinq membres en remplacement des cinq membres dont le mandat venait à échéance à la fin du la 20e session de la Conférence générale et, d'autre part, six nouveaux membres dont la durée du mandat serait déterminée par un tirage au sort. Le mandat de deux États viendrait à échéance à la fin de la 21e session de la Conférence générale, celui de deux autres États à la fin de la 22e session de la Conférence générale et celui des deux derniers à la fin de la 23e session de la Conférence générale. Le tirage au sort serait effectué par le Président de la Conférence générale conformément à l'article 9, paragraphe 2, de la Convention.

     

    11. Quelques délégués ont fait référence aux termes de la Convention selon lesquels tout État partie à la Convention qui est en retard dans le paiement de sa contribution obligatoire ou volontaire en ce qui concerne l'année en cours et l’année civile qui l'a immédiatement précédée n'est plus éligible au Comité du patrimoine Conformément à cette disposition, les délégués de la République fédérale d'Allemagne et du Costa Rica ont retiré leur candidature. Ils ont expliqué à l'Assemblée que le retard enregistré dans le paiement de leur contribution était dû à des raisons budgétaires, mais que leur gouvernement prendrait les mesures nécessaires pour s'acquitter de ce versement dans un délai assez bref.

     

    12. Plusieurs délégués ont ensuite abordé le problème de la répartition géographique en se référant à l'article 8, paragraphe 2, de, la Convention selon lequel l’élection des membres du Comité doit assurer une représentation équitable des différentes régions et cultures du monde. L'un d'eux, se fondant sur la pratique suivie pour los élections à d'autres organes de l'Unesco et sur la distribution des 40 États parties à la Convention entre les groupes électoraux pour les élections au Conseil exécutif, a proposé que les 21 sièges du Comité soient attribués de la façon suivante : 5 sièges au groupe 1, 2 au groupe II, 4 au groupe. III, 3 au groupe IV et 7 au groupe V. Cette proposition a suscité un large échange de vues sur le principe devant régir la répartition des sièges. Certains orateurs ont proposé une représentation différente selon ces mêmes groupes ou la formation de groupes différents, mais d'autres ont fait observer que la procédure ne pouvait pas être la même pour les élections concernant les 145 États membres de l'Unesco et pour l'élection des membres du Comité, puisque la Convention ne regroupait à ce jour que 40 États. De nombreux délégués ont souligné la nécessité de faire preuve de flexibilité étant donné que le nombre des: États parties était appelé, à s'accroitre, et qu'il serait dangereux d'établir des principes rigides créant un précédent pour les élections futures.

    13. Compte tenu du souhait de tous d'obtenir une répartition géographique équitable et pour permettre aux délégations d'arriver à un accord, le Président a proposé une suspension de séance ; l'accord n'ayant pu se réaliser, il a suggéré que les représentants procèdent à l'élection au scrutin secret tout en gardant présente à l'esprit l'obligation morale d'établir une juste répartition. Pour aider à clarifier la situation, le délégué de la Pologne a retiré sa candidature au profit de celle de la Bulgarie.

     

    14. D'autres questions relevant plus spécifiquement de la procédure du vote lui-même ont été soulevées ; en particulier la question de savoir si les cinq États membres dont le mandat venait à expiration à la fin de la 20e session de la Conférence générale pouvait être réélus au nouveau Comité. Le sous-Directeur général adjoint (activités opérationnelles) du Secteur de la Culture et de la Communication a répondu que les termes de la Convention ne s'y opposaient pas. Un délégué qui a reçu l'appui d'un grand nombre de délégations, a proposé que l'Assemblée procède à un seul vote pour les onze membres à élire. Les cinq candidats qui réuniraient le plus de voix seraient élus comme remplaçants des cinq membres sortants et les six candidats suivants seraient considérés comme élus aux six nouveaux sièges et par conséquent soumis au tirage au sort. Cette proposition a été acceptée par l’Assemblée.

     

    15. Le Président ayant désigné les délégués du Costa Rica et de l'Egypte comme scrutateurs, l'Assemblée générale a procédé au vote. Les résultats du scrutin, proclamés par le Président; ont été les suivants :

Un délégué a souligné l'importance des travaux accomplis par le Comité et il a invité les délégations à prendre connaissance de deux documents fondamentaux pouvant servir de base à la suite qui sera donnée à l'action entreprise.     20. Les représentants des trois organisations ayant voix consultative auprès du Comité ont pris la parole. Le représentant de l’UICN a rappelé le souhait exprimé par les membres de son organisation lors de la dernière Assemblée générale de l’UICN, que les intérêts du patrimoine culturel et naturel soient représentés de manière équilibrée au sein du Comité. Le représentant de l’ICOMOS après s'être félicité de l'accroissement du nombre des États parties à la Convention, a offert l'assistance de son organisation aux membres pour la mise en œuvre de leurs programmes, et le représentant de l'ICCROM a proposé l'aide de son organisation aux États membres pour des projets de recherche et de formation du personnel.]]>
